Above has zero tolerance for child sexual abuse and exploitation ("CSAE") of any kind. Our platform is strictly for adults aged 18 and over, and any content, communication, or conduct involving the sexual exploitation, abuse, or endangerment of a minor is prohibited and will result in immediate and permanent account termination.

Age Requirement and Verification

All members must be at least 18 years of age. We verify age through self-attestation at registration, photo verification requirements, and ongoing review of user profiles and activity. Accounts suspected of being operated by minors are immediately suspended pending review, and confirmed cases are permanently banned.

Above does not guarantee any particular outcomes from using the Service.

9. Intellectual Property

The Above name, logo, website design, features, and all related intellectual property are owned by Above and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without prior written consent.

10. Limitation of Liability

Above is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, Above shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages related to interactions with other members.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to Above in the twelve (12) months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other members, or is otherwise inappropriate. You may delete your account at any time through your account settings.

12. Dispute Resolution

Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the state of Delaware, and the arbitrator's decision shall be final and binding.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
